1. Payment & Orders
- All orders must be paid in full before dispatch.
- Orders ship within 2 working days after cleared payment.
- Credit card payments incur a merchant surcharge.
- Pricing, specifications, and availability may change at any time.
- If a change affects your order, we will advise available options to proceed, substitute, or refund.
2. Delivery, Risk & Ownership
- Risk transfers on collection or delivery.
- Title transfers once full payment is received.
- We are not liable for freight delays or events beyond our reasonable control.
3. Scope of Supply
Solar Partners Direct supplies equipment only unless expressly stated.
We do not perform installation, electrical work, or on-site services.
4. Installer Responsibilities
All installations must be performed by a licensed, qualified installer engaged by the customer or referred through our installer network.
Installers operate as independent contractors, not employees or agents of Solar Partners Direct.
Installers are solely responsible for:
- Mechanical and electrical design, installation, and commissioning
- Compliance with AS/NZS 5033:2021, AS/NZS 3000, AS/NZS 4777.2:2020, AS/NZS 1170.2:2021, and all local authority and network requirements
- Structural assessments, fixings, flashings, and waterproofing
- Earthing, bonding, cable protection, and corrosion prevention
- Obtaining all consents, DG approvals, CoCs, and RoIs
5. Design Services
Nature of the Service
Our design and scoping service is a pre-installation advisory service intended to assist with:
- identifying suitable Products for your property;
- sizing and selecting appropriate components; and
- producing preliminary layout concepts or a bill of materials (where applicable).
This service provides kit selection, system sizing guidance, and indicative design concepts only.
No Substitute for Installer Design Obligations
The information we provide does not constitute an installation-ready mechanical or electrical design.
All installers—regardless of how they are engaged—are solely responsible for:
- completing full mechanical and electrical design to NZ regulatory standards;
- verifying the suitability of all Products for the specific site conditions;
- ensuring structural adequacy of the roof and supporting elements;
- confirming shading, layout, stringing, wiring, protection devices, and inverter configuration;
- ensuring compliance with AS/NZS 5033:2021, AS/NZS 3000, AS/NZS 4777.2:2020, AS/NZS 1170.2:2021;
- meeting all local authority and network/distributor requirements;
- preparing the final installation plan, diagrams, string schedules, earthing/bonding requirements, and as-built documentation.
No Engineering, Structural, or Building Certification
Our design service does not include:
- structural engineering, load calculations, or roof capacity confirmation;
- engineering review or sign-off (PS1 / PS4);
- wind-zone or seismic assessment;
- waterproofing design or flashing specification;
- on-site verification or measurement;
- shading modelling, drone imagery, or site inspection.
If structural or engineering queries arise, the installer or customer must engage a qualified structural engineer.
Accuracy of Information Provided by the Customer
Our recommendations rely on the information, photos, plans, and measurements supplied by the customer or installer.
We are not responsible for inaccuracies or design changes arising from:
- incorrect or incomplete information;
- undisclosed site constraints;
- incorrect roof measurements, pitch, or orientation data;
- concealed damage, structural issues, or non-standard roofing profiles.
Installer Verification Required
Before installing any system, the installer must:
- verify site conditions, structural capacity, corrosivity zone, and compliance requirements;
- confirm mechanical fixing requirements, embedment depth, and rafter/purlin positioning;
- validate cable sizing, protection devices, inverter configuration, and isolator placement;
- ensure materials are compatible to prevent electrochemical corrosion;
- confirm the final design meets all applicable NZ standards and network rules.
No Warranty on Installer Design Outcomes
Our design service does not guarantee:
- system performance or energy yield;
- install-ability of the system at the site;
- compliance of the final installation;
- workmanship, layout decisions, or installation quality;
- the installer's choice or placement of components.
6. Warranties
All equipment is covered by manufacturer warranties.
Warranty excludes damage caused by incorrect installation, non-compliant work, or third-party components not purchased from us.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA).
7. Returns
Return Window
Returns are accepted within 14 days of delivery for unused items in their original, unopened packaging, accompanied by proof of purchase.
Condition of Returned Goods
Returned products must be:
- unused,
- unmarked,
- in re-saleable condition,
- complete with original packaging, labels, manuals, and accessories.
Non-Returnable Items
The following items cannot be returned unless required by law:
- custom kits or system designs;
- special-order or indent items;
- cut-to-length items (rails, cable, trunking, conduit, etc.);
- products supplied for a specific custom design;
- clearance or end-of-line items (where disclosed).
Restocking Fees
A restocking fee of up to 20% may apply to returned items to cover handling, administration, inspection, and restocking costs.
The fee depends on the condition of the returned goods and any repackaging required.
Return Freight Costs
The customer is responsible for:
- arranging return freight; and
- all costs associated with returning Products to Solar Partners NZ Ltd (Hamilton warehouse).
We can arrange return freight on request, and the cost will be deducted from the refund amount.
Damaged or Insufficiently Packaged Returns
If Products are damaged in transit due to inadequate packaging, repair costs or loss in value may be deducted from the refund.
Products that arrive in non-resaleable condition may be rejected.
Refund Processing
Refunds are processed after:
- the returned Products are received;
- inspected; and
- confirmed as meeting all return requirements.
Refunds will be issued to the original payment method.
Consumer Rights Preserved
Nothing in this Returns Policy limits rights under the Consumer Guarantees Act 1993.
8. Liability
8.1 Installer Workmanship and Conduct
Solar Partners Direct accepts no liability whatsoever for the workmanship, actions, omissions, advice, or conduct of any installer—whether engaged independently by the customer or introduced through our installer network.
8.2 Installation-Related Damage
Solar Partners Direct is not liable for any damage or defect arising from installation activities, including:
- roof penetrations, waterproofing failures, or water ingress;
- damage to roofing materials, flashings, cladding, or structure;
- structural failure caused by incorrect fixing or load distribution;
- electrical faults, arcing, overheating, or non-compliant work;
- incorrect racking installation, earthing, bonding, or cable management.
8.3 System Performance and Suitability
We are not liable for system performance issues including:
- reduced yield, shading, orientation or pitch limitations;
- incorrect system sizing by the installer;
- incorrect application of Products;
- unverified or undisclosed site conditions;
- performance variations due to environmental factors.
8.4 Third-Party Products and Modifications
We are not liable for damage or faults caused by:
- third-party components not supplied by us;
- modifications or substitutions made by installers or third parties;
- integration of incompatible or non-approved components.
8.5 Customer-Provided Information
We are not responsible for loss or damage resulting from inaccurate, incomplete, or misleading information supplied by the customer, installer, or any third party.
8.6 Environmental, Site, and External Factors
We are not liable for damage or system issues arising from:
- corrosive environments beyond product specifications;
- severe weather events (including wind uplift, hail, storms, salt exposure);
- latent structural defects or site constraints;
- network approvals, delays, grid limits, or export restrictions.
8.7 Consequential, Indirect, and Special Losses
To the fullest extent permitted by NZ law, Solar Partners Direct is not liable for:
- loss of profits, savings, or revenue;
- business interruption or loss of data;
- costs of reinstallation, removal, replacement, or labour;
- damages arising from system downtime or underperformance.
8.8 Maximum Aggregate Liability
Our maximum aggregate liability for any claim is strictly limited to the amount paid by the customer for the Products supplied under the specific transaction giving rise to the claim.
8.9 Installer Independence
Installers are not employees, agents, or representatives of Solar Partners Direct.
We accept no responsibility for their workmanship, safety practices, scheduling, communication, compliance, or design decisions.
8.10 Consumer Guarantees Act 1993
Nothing in this clause limits rights available under the Consumer Guarantees Act 1993.
All other warranties or representations not expressly stated are excluded to the extent permitted by law.
9. Governing Law
These Terms are governed by the laws of New Zealand. Any claim, dispute, or proceeding arising out of or relating to these Terms, the Products supplied, or any transaction with Solar Partners Direct must be resolved under New Zealand law. The customer agrees that the New Zealand courts have exclusive jurisdiction over all such matters.
